CalFireHelp Mandatory Terms of Use

Your use of CalFireHelp constitutes your acceptance of, and agreement with, CalFireHelp's mandatory Terms of Use. With each and every use of CalFireHelp, you understand and affirm your agreement to CalFireHelp's Terms of Use.

CalFireHelp is made available to you "as is" and "as available".

You agree to use CalFireHelp only for legal purposes.

You agree that any information you provide in order to obtain a user name and password on CalFireHelp is fully accurate and true. You may be excluded or removed from CalFireHelp at any time if such information is inaccurate or untrue.

Please remember that CalFireHelp is designed to appeal to a broad audience. You agree never to use CalFireHelp to publish, post, distribute, or disseminate any defamatory, obscene, or other unlawful material or information, including information of a proprietary nature that belongs to another, including trademarks or copyrighted information, without receiving, prior to any and all use of that material or information, express authorization from the holder of the relevant proprietary right.

You agree never to use CalFireHelp to collect or harvest personal information or any data about CalFireHelp users. CalFireHelp reserves exclusively to itself the unlimited right to use, for any purpose, any and all data and/or information provided or generated by a user, including, but not limited to, data and/or information provided by a user in return for a user name and/or password.

You must abide by any and all policies posted on CalFireHelp (including those accessible by hotlink). You understand and agree that CalFireHelp provides no assistance, including the review, removal, or editing of content posted on, or any user support for the use of, CalFireHelp.

You agree that CalFireHelp assumes no responsibility for the timeliness, deletion, misdelivery, or failure to store any user names, passwords, trackables, samples, images, or other data. You agree that CalFireHelp is not responsible for the results of any defects that exist in CalFireHelp, or any resulting lost data or information. You agree not to assume that CalFireHelp or its content is error-free or that it will be suitable for the particular purpose that you have in mind when using it. You agree that CalFireHelp may, in its sole discretion and at any time, modify or discontinue CalFireHelp. Furthermore, you agree that CalFireHelp may limit, terminate, or suspend your use of, or access to, CalFireHelp. You also agree that CalFireHelp may make changes to these Terms of Use at any time.

You agree that you are solely and fully responsible for maintaining the confidentiality of your user name and password, and are solely and fully responsible for all activities that occur under your user name and password. You agree that CalFireHelp cannot and will not be liable for any loss or damage arising from your failure to maintain confidentiality. You understand and agree that all information, data, text, or other materials posted on CalFireHelp, are the sole responsibility of the person who posted them, and not the responsibility of CalFireHelp. You agree that you, and not CalFireHelp, are solely and fully responsible for all content that you post or otherwise transmit via CalFireHelp. You understand and agree that CalFireHelp does not control the content posted and, as such, does not guarantee the accuracy, integrity, or quality of such content. You understand and agree that, by using CalFireHelp, you may be exposed to content that is offensive, indecent, profane, or objectionable in any way. You agree that under no circumstances will CalFireHelp be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted or otherwise transmitted via CalFireHelp.

You understand and agree that CalFireHelp provides no assistance, including any technical or user support, in the use of CalFireHelp, and that your use of CalFireHelp is entirely at your own risk. CalFireHelp is provided "AS IS" and "AS AVAILABLE" and no warranties are provided. SPECIFICALLY, CALFIREHELP HEREBY DISCLAIMS ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

You understand and agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. In this regard, you understand and agree that you may not rely on any content created by CalFireHelp or submitted to CalFireHelp.

You understand and agree that CalFireHelp is in no way liable for any claims arising from your use of CalFireHelp. As a necessary condition of your use, you and agree to indemnify CalFireHelp entirely for all claims relating to your use of CalFireHelp. CalFireHelp reserves the right, in its sole discretion and at any time, to modify or discontinue CalFireHelp, and to limit, terminate or suspend your use of CalFireHelp. CalFireHelp also reserves the right to change these Terms of Use at any time.

Given the international nature of the internet, you agree to comply with all local laws, articles, rules, and regulations that govern online conduct and acceptable content. Specifically, you agree to comply fully with all laws that apply to the transmission of technical data exported from the United States or the country in which you reside.

CalFireHelp reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, CalFireHelp (or any part thereof) with or without notice. You understand and agree that CalFireHelp shall not be liable to you or to any third party for any modification, suspension, or discontinuance of CalFireHelp.

CalFireHelp grants you limited permission to use the object code of its software on a single computer, provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software. You agree not to modify the CalFireHelp software in any manner or form, or to use modified versions of the CalFireHelp software, including, without limitation, for the purpose of obtaining unauthorized access to CalFireHelp. You agree not to access CalFireHelp by any means other than through the web-based graphical user interface that is provided by CalFireHelp for use in accessing CalFireHelp.

The documents and information on CalFireHelp's website are copyrighted materials of CalFireHelp. Reproduction or storage of materials retrieved from CalFireHelp is subject to the U.S. Copyright Act of 1976, Title 17 U.S.C.

The logos "CalFireHelp", "CALFIREHELP", "CalFireHelp.com", and "CALFIREHELP.com", regardless of the visual form or orientation in which they appear, belong exclusively to CalFireHelp. CalFireHelp reserves all rights.

CalFireHelp respects the intellectual property of others, and users must do the same. CalFireHelp may, in appropriate circumstances, and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, CalFireHelp has a policy of terminating, in appropriate circumstances and at CalFireHelp's sole discretion, members who are deemed to be repeat infringers.

CalFireHelp is not intended for use by individuals under the age of 18. You agree not to encourage individuals under the age of 18 to use CalFireHelp. If you are under 18, you must not use CalFireHelp.

You agree to be responsible and to respect other users and non-users of CalFireHelp. You agree to order your conduct based on the principles of honesty, good faith, good will, reasonableness, common sense, basic etiquette, and these rules.

You agree not to do any of the following:

* Post or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
* Use rude, explicit, profane, vulgar, obscene, or offensive language.
* Post or reference sexually explicit or other offensive content.
* Harm minors (any person under the age of 18) in any way.
* Discuss, encourage, or incite illegal activity, such as how to build a bomb, counterfeit money, et cetera.
* Solicit for the exchange of sexually explicit images, and/or material harmful to minors, including, but not limited to, any photograph, film, video, picture, or computer generated image or picture (actual or simulated).
* Harass, threaten, embarrass, insult, "stalk", or otherwise harm other users or non-users.
* Post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed in the scope of any employment relationship or under any nondisclosure agreement).
* Post or otherwise transmit any material that contains software viruses or any other computer code, computer files, or computer programs that are designed to interrupt, destroy, or limit the functionality of any computer software, computer hardware, telecommunications equipment, or any other kind of equipment.
* Disguise the origin of any content posted to, or transmitted through, CalFireHelp.
* Offer for sale, either directly or indirectly, any products or services.
* Infringe anyone else's intellectual property rights, including, but not limited to, any copyright, trademark, patents, rights of publicity, or any other proprietary rights.
* Impersonate or represent CalFireHelp or community leaders.
* Solicit a CalFireHelp user's user name, password, or any other information or data.
* Harvest screen data or any other type of data.
* Post or request personal or other information from a minor (any person under the age of 18), including, without limitation, any of the following: full name, partial name, home address, parentNASDAQ, the Toronto Stock Exchange, the Montreal Stock Exchange, the Vancouver Stock Exchange, the London Stock Exchange, and any regulations having the force of law.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF CALFIREHELP IS FULLY AT YOUR SOLE RISK. CALFIREHELP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CALFIREHELP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; CALFIREHELP MAKES NO WARRANTY THAT (1) CALFIREHELP WILL MEET YOUR REQUIREMENTS, (2) CALFIREHELP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF CALFIREHELP WILL BE ACCURATE, RELIABLE, OR USEFUL (4) THE QUALITY OF ANY INFORMATION OBTAINED BY YOU THROUGH CALFIREHELP WILL MEET YOUR EXPECTATIONS, AND (5) ANY ERRORS IN THE CALFIREHELP SOFTWARE WILL BE CORRECTED; RELIANCE ON ANY INFORMATION OBTAINED THROUGH THE USE OF CALFIREHELP IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM USE OF CALFIREHELP.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT CALFIREHELP SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR INFORMATION, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: THE USE OR THE INABILITY TO USE CALFIREHELP; THE INFORMATION OBTAINED THROUGH OR FROM CALFIREHELP; UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS; STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON CALFIREHELP; OR ANY OTHER MATTER RELATING TO CALFIREHELP.

By using CalFireHelp, you agree to abide by any and all of the above conditions and rules, without exception or variation.
